When you use the APP we collect and process your personal data for the following purposes:

The email address and identification details you provide us with when you register on the app are used to register you as a user of it. The data relating to your booking are used to identify you and allow you to manage the different options offered on the APP.

The data collected during your use of the APP, relating to your IP address and the options you select from the menus or the technical data on the device you are using, are processed to ensure the functioning of the APP.

The data you provide in the pre check-in process are communicated to the hotel so they are available on your arrival and to facilitate the identification process and your registration as a guest at our hotel. The data requested for this process include your photograph and/or photographs of documents. To this end, the App will request access to your camera or to the photos stored on your device.

The data you provide through the processes for booking hotel products and services available on the APP are used to process your requests and to make the bookings you ask for. These data will be communicated to the hotel where you will be staying for this same purpose.

The legal basis for this processing is fulfilment of the legal relationship established at the moment you register as a user of the APP.

Your consent will be obtained for the processing of any images you provide us with during the pre check-in process. To do this, your permission will be requested before activating the camera or accessing the photos on your device. If you do not consent to the processing of these images, it is possible that your identification process when you arrive at the hotel will be much slower, but it will not affect the conditions of your booking or the services you have contracted with us in any way.

We will use your email address to send you commercial communications about tourist services offered by Grupo Piñero. We will do this on the basis of our legitimate interest in making our services known and on the basis of your consent to this communication being carried out via electronic means. We understand that sending these communications is compatible with your data protection rights and that it does not entail unexpected or incompatible processing within the framework of our relationship with our customers. In any case, you can withdraw your consent at any time if you do not wish to receive these communications, using the mechanism described in each communication.

If you participate in any of our surveys using the APP, we will process the data collected for the purpose of improving the products and processes of the whole of Grupo Piñero. This will be done on the basis of our legitimate interest in improving our management and the way we look after our customers. We understand that this processing is compatible with your data protection rights, as part of a voluntary and conscious contribution on your part, and the responses given do not in any way condition your relationship with us as an individual customer.

The APP identification and access data is held for as long as you are a user of it.

The data used for commercial purposes will be held until their cancellation is requested.

You are entitled to obtain confirmation of whether or not we are processing your personal data and, if we are, you have the right to access them.  You may also request that your data are corrected when they are inaccurate, or completed when incomplete, as well as request their erasure when the data are no longer necessary for the purposes for which they were collected, among other reasons.

Under certain conditions and for reasons related to your specific situation, you may also oppose the processing of your data. In this case we will cease processing your data except for legal reasons that prevail over your interests, rights and freedoms, or to formulate, file, or defend against claims.

Furthermore, you may withdraw your consent for specific purposes at any time and oppose the processing of your data for direct marketing purposes or commercial profiling. In this case we will cease processing your personal information for these purposes. Withdrawal of consent will not affect the legality of processing based on prior consent.

Furthermore, and under certain conditions, you may request the portability of your data so that they are transferred to another data controller.

You are also entitled to file a complaint with the Spanish Data Protection Authority or any other competent supervisory authority.

To exercise your rights, you should send a request together with a copy of your national identity document, or another valid identification document, by post or email to the addresses of the data controller that appear at the top of this policy.

General Conditions of the Contract

The purpose of this document is to inform you of the general contract conditions applicable to the services offered on the APP (hereinafter the APP), for your stay in Bahia Principe Hotels.

On this APP we provide you with information on the services offered by MANAGEMENT HOTELERO PIÑERO S.L. (hereinafter MHP), with taxpayer identification number [C.I.F.] B57211732, and registered office at Plaza Mediterráneo nº5 Ed. Neptuno 07014 - Palma de Mallorca, Balearic Islands, Spain, telephone: 900 535 167 / + 34 971 225 614 and email: reservations@bahiaprincipe.com

The features offered by the APP include:

  • Consulting and booking entertainment activities and shows.
  • Making dinner and buffet reservations in your favourite restaurants.
  • Consulting all the information on available excursions, spa treatments, golf services, premium WiFi, and signing up for these services, as appropriate.
  • Making requests to administration and room service.

Using this APP and the services it offers implies acceptance of the privacy policy and the latest version of these terms and conditions. For this reason, we advise you to read these conditions before signing up and each time you access our APP, since we reserve the right to change, amend, add and delete, at any time, any part of these general conditions.

CONDITIONS OF USE OF THE APP

As a user of the APP, you agree to use it and the services it offers lawfully, in accordance with the provisions of these general conditions and in a way that does not harm the rights or interests of third parties or which could damage or result in the abnormal use of the APP.

EXCLUSION OF LIABILITY

Use of the APP: This APP is used at the risk of the user and, therefore, MHP shall not be liable for any possible damages resulting from interferences, interruptions, computer viruses, telephone system faults or disconnections arising from causes not attributable to the APP; delays or blockages in the use of this electronic system caused by deficiencies or overloads in the data processing centre, the Internet system or other electronic systems; or for any other alteration that may occur in the Users’ Software or Hardware.

Likewise, MHP will not be liable for any damages caused by third parties through illegitimate interference beyond our control. It will also not be liable for any harm or damages resulting from the use or misuse of the content of the APP or for any consequences that may arise from errors, defects or omissions in any content that may appear on this APP provided by third parties. Third party, for these purposes, refers to the Users of the APP in general and the person responsible for the booking, in particular.

BOOKING AND CONTRACT CONDITIONS

Management of your booking and, where applicable, hiring the services offered on the APP are subject to the following clauses:

  1. Declarations:

You declare that:

(i) you have full capacity to manage the booking and/or to sign up for the services found on the APP

(ii) that the data supplied when you make the service bookings are truthful, complete and concise

(iii) you confirm the booking made and/or service signed up for, that is, the date and time and number of people.

The person responsible for the booking declares that they have the capacity to manage it and/or sign up for the service and they also declare that they know and accept the terms and conditions set out in this document.

  1. Access to the APP:

Access to this APP is the responsibility of the User.

The User is responsible for keeping and treating their APP access credentials confidential, preventing their use by unauthorised third parties.

Likewise, the User declares that all the information supplied by them to access the APP and while using it is truthful, complete and accurate and, therefore, they agree to keep it up to date in the successive uses they might make of the services offered on the APP.

  1. Processing bookings and service contracts via the APP

3.1. The processing of bookings of services offered on this APP may be carried out in some cases either on-line, using the APP, or via the website of the service provider whose services you wish to hire.

  • Bookings and/or service contracts made on-line will be subject to these conditions.
  • Off-line contracts will be subject to the contract terms and conditions issued by the service provider.

3.2. To make a booking and/or hire a service on the APP, you need to go to the “My Plans” screen and the process is carried out through the following steps.

1) Select the service you wish to book.

2) Select the number of people covered by the service.

3) Select the date and time.

4) Booking summary.

5) Booking confirmation.

3.3. At each step of the booking, any errors made when entering the details can be corrected by using the “back” functionality on your device. Likewise, in the Booking Confirmation, the booking details will be summarised. In the event that any errors are detected, users should make the relevant corrections immediately via the APP, or, where applicable, notify the Hotel.

3.4. Once the booking has been made, you will be able to access it at any time via the “My Plans” section of the APP.

Likewise, you can carry out the following additional processes on your bookings, with certain restrictions:

  • Cancel the booking.
  • Change the number of people covered by the service.
  1. Price:

4.1. The prices of the services that can be booked via the APP are expressly set out in the fee conditions found on the screen that is shown after you select the service you wish to use.

The services listed below come at no extra charge:

  • Booking activities from the entertainment programme.
  • Consulting restaurants, dinner and buffet reservations.
  • Booking training sessions in the hotel gym.
  • Requesting available Concierge services.
  • Making room service requests.

4.2. The prices indicated on the APP are the retail prices with indirect taxes included.

4.3. The transaction will be made in EUROS, whatever the origin of the Customer.

  1. Payment method:

The payment method for each of the services available via the app is the following:

• Spa and related services bookings: the charge will be added to your bill, payable at the moment you check out.

• Excursion bookings: payment should be made at the Tours desk.

• Golf service bookings: the payment will be processed and paid off-line on the GOLF platform.

• Show bookings: the charge will be added to your bill, payable at the moment you check out.

• Premium WiFi: the charge will be added to your bill, payable at the moment you check out.

  1. Cancelling bookings.

Cancellations may entail management charges.

  1. Acceptance

MHP reserves the right to amend, limit or cancel these General Conditions at any time.

If any clause in these general conditions is declared fully or partially void, or ineffective, the remaining general conditions will prevail, and that clause, or the part of it that is affected, will be taken as not being included.

MHP reserves the right to refuse or withdraw access to the APP at any time, and without the need for prior notice, for any Users who breach these General Conditions or who misuse the services and content published on it.

The formalisation of bookings and/or service contracts via the APP implies your necessary and express acceptance of:

  1. these conditions
  2. the particular conditions of the service fee
  3. the APP privacy policy 
  4. the confirmation and booking request

For any queries or disputes in relation to performance, interpretation or resolution, the Parties submit to the jurisdiction of the Courts and Tribunals of Palma de Mallorca (Balearic Islands, Spain).

Legal Conditions of the APP

Access to the Bahia Principe Hotels APP (hereinafter the APP), gives you the status of USER and involves full and unreserved acceptance, from the moment of access and/or use, of this legal notice and of the latest version of the privacy policy, without prejudice to any General Contract Conditions that, as appropriate, may be applicable. For this reason, we advise you to read these documents before using the features offered by the APP and each time you access it, since we reserve the right to change, amend, add and delete, at any time, any part of these conditions.

OWNER OF THE APP

In accordance with the provisions of Article 10 of Law 34/ 2002, of 11 July, on Information Society Services and Electronic Commerce, the following information is provided on the ownership of this APP:

CONDITIONS OF USE

1. Introduction. On this APP, MHP offers users the possibility to check-in online, to speed up their arrival at the hotel, and express checkout before their departure. They can also consult all the information on the hotel and their booking, consult and book entertainment activities and shows, make dinner bookings, consult all the information on available excursions, spa treatments and other services, such as requests to administration and room service. By accessing and using this APP you agree to abide by the conditions set out below, and it is therefore recommended that you read this section carefully before you begin browsing.

2. User Obligations. Users agree to use this APP in a lawful manner, in accordance with the provisions of these conditions and in a way that does not harm the rights or interests of MHP or third parties. By way of example, and without limitation or exclusion, the User also agrees:

  • Not to undertake illegal activities or those that are contrary to public order or good faith;
  • Not to try to access, modify, manipulate or, where applicable, use the accounts of other Users;
  • Not to use the data published on the APP to send unsolicited communications (spam).
  • Not to enter or disseminate on the APP any information or content that is false, deceitful, ambiguous or inaccurate and that could mislead the recipients of the information, nor to disseminate content of a racist, xenophobic, pornographic, or terrorism apologist nature or which poses a threat to human rights or the rights of children;
  • Not to undertake actions that constitute or entail a breach of the intellectual property rights of MHP or of third parties;
  • Not to cause damage to the physical or logical systems of MHP, of its suppliers or third parties;
  • Not to introduce or disseminate on the network any computer viruses or to use any other physical or logical systems that may be liable to cause the above mentioned damages.
  • Not to remove, alter, elude or manipulate any protection device or security system that may be installed on the pages of this APP.

3. Exclusion of liability. This APP is provided “as is” and its use is at the risk of the User. Consequently, neither MHP nor its administrators, employees, suppliers or collaborators will be liable for any direct or indirect damages of any kind resulting from the use of the APP, and MHP expressly rules out any type of guarantees, either express or implicit, in as far as provided for by Law.

MHP does not guarantee the availability and accessibility of the APP, although it will make every reasonable effort in this regard. On occasions, there may be interruptions for the period of time required to carry out the relevant maintenance operations.

MHP accepts no liability for any possible damages resulting from interferences, interruptions, computer viruses, Trojans and malware in general, or for any other alteration that may occur in users’ software or hardware, for reasons beyond the control of the aforementioned entity. Nor does it guarantee the absence of viruses, malware, Trojans or any other elements that may cause alterations to the User's IT system, documents or files, and will not be held liable for any damage of any kind caused to the User for this reason. Likewise, MHP will not be liable for any damages caused by third parties with illegitimate interference beyond its control.

MHP will also not be liable for any harm or damages caused by the use or misuse of the content on the APP or for any consequences that may arise from errors, defects or omissions in any content that may appear on this APP provided by the Users themselves or other third parties. MHP accepts no liability or responsibility for any services that are not provided by it directly.

4. External links. MHP will not, under any circumstances, be held responsible for any of the content on links belonging to a site outside the APP, and will not guarantee the technical availability, quality, reliability, accuracy, extent, truthfulness, validity or legality of any material or information contained in such hyperlinks or other Internet sites. Furthermore, the inclusion of these external links does not imply any kind of association, merger or participation in the linked entities.

5. Passwords.  Passwords for accessing registered user accounts are personal, confidential and non-transferable. Registered Users have sole responsibility for maintaining the confidentiality and security of their account, and will assume exclusive responsibility for any consequences resulting from the activities they carry out using it. Users undertake to notify MHP immediately of any security breaches associated with their account.

6. Denying access and cancelling accounts. MHP reserves the right to deny access to the APP and to suspend or cancel the accounts of Users who fail to comply with these conditions; in the event of unforeseen technical problems or security issues; in the event of inactivity of the account for a significant period of time; or in compliance with a police, judicial or administrative demand and/or order.

The cancellation or suspension will be carried out exclusively at the discretion of MHP and will not give rise to any sort of compensation.

7. Personal data processing. Users can find information on the processing of their personal data and on how to exercise their data protection rights by accessing the APP privacy policy.

8. Intellectual property and copyright. Notwithstanding the content over which third parties have intellectual rights, the intellectual property rights of the APP, the domain name, its source code, design and browsing structure and elements contained in it (for example, images, sound, audio, video, software, or texts; brands or logos, colour combinations, structure and design, etc.) are the property of MHP, which has exclusive exploitation rights of them in any form and, in particular, reproduction, distribution, public communication and transformation rights, as provided for in the current Intellectual Property Act. The user is expressly prohibited from the reproduction, distribution, and public communication, including any means of making all or part of the content of this APP available, on any medium and by any technical means without the authorisation of MHP or, where applicable, of the third parties who hold the intellectual property rights or copyright of the affected content. Notwithstanding the foregoing, the User of the APP may view the elements of this APP and print them, copy them and store them on the hard drive of their computer or any other physical medium, provided it is solely and exclusively for their own personal and private use. Any entities or persons who, with the prior authorisation of the owner of this APP, aim to establish a link to it, must guarantee that it only permits access to this APP or service and does not reproduce its content or services.

9. Nullity of a clause If any clause in these conditions of use is declared void this will only affect that clause, or the part of it declared to be so, and the remaining conditions will prevail, and that clause, or the part of it that is affected, will be taken as not being included.

10. Acceptance. Access to the APP and its use necessarily involve your express acceptance of these conditions of use.

11. Applicable law and jurisdiction. Without prejudice to the consumer rights provided for in Royal Legislative Decree 1/2007, of 16 November, this APP will be governed by Spanish Law with the exception of its conflict-of-laws rules, and any dispute that may arise from its use, or use of the services linked to it, will be subject to the jurisdiction of the competent Courts and Tribunals in compliance with applicable legislation.
