In compliance with the provisions of Law 34/2002 of July 11, on Information Services and Electronic Commerce, the following information is provided:

1.- GENERALITIES

1.1. The terms and conditions set forth below regulate the access and use of the present Website www.bahia-principe.com (hereinafter Website), whose operation and through which the legal entity VIAJES GTI GRUPO TURÍSTICO INTERNACIONAL S.A. (hereinafter BAHIA PRINCIPE HOTELS & RESORTS), with CIF A30350714 and registered office at Plaza Mediterráneo, 5 07014 Palma de Mallorca (Balearic Islands), provides information society services. Registered in the commercial register of Palma de Mallorca, volume 2410, folio 67, page PM-65088.

1.2. The term "Website" includes but is not limited to the data, texts, graphics, images, animations, musical creations, videos, sounds, drawings, photographs, trademarks, trade names, domain names and other included in it, and in general, all creations, original or not, expressed by any means or medium, tangible or intangible, regardless of whether they are susceptible to protection under the current Intellectual Property Law or any other industrial property law.

1.3. Access to the Website implies that the User acquires a series of rights and obligations in order to ensure the proper enjoyment of the services and contents found therein and that BAHIA PRINCIPE HOTELS & RESORTS makes available to the User free of charge.

1.4. The User is aware that access to and use of the services and contents of the site is carried out under his sole and exclusive responsibility.

1.5. The status of "User" is acquired by accessing the Website. The User will use the services and contents exclusively for personal purposes and/or due to his legal relationship that links him to BAHIA PRINCIPE HOTELS & RESORTS, excluding any subsequent use of the same for profit or benefit, direct or indirect.

1.6. BAHIA PRINCIPE HOTELS & RESORTS informs the User of the following general conditions of use, which are expressly and fully accepted by the latter by the mere fact of accessing the Website and/or viewing the contents or using the services contained therein.

If these general conditions are replaced by others in whole or in part, such new general conditions shall be deemed accepted in the same manner as set forth herein. However, the User of the Website should periodically access these general conditions to be aware of the successive versions included here, although it is recommended that the User access them each time he intends to access or use the services and contents of the Website.

If the User does not accept these general conditions or the particular conditions that regulate the use of a specific service and/or content intended for the Users of the Website and that BAHIA PRINCIPE HOTELS & RESORTS determines, the User will refrain from accessing the Website and/or using the services made available to him.

1.7. BAHIA PRINCIPE HOTELS & RESORTS may establish as many particular conditions as necessary to regulate the use and/or contracting of specific services offered to Users through the Website. Likewise, through the Website, BAHIA PRINCIPE HOTELS & RESORTS may enable third entities to advertise or provide their services. In such cases, BAHIA PRINCIPE HOTELS & RESORTS shall not be responsible for establishing the general and particular conditions to be taken into account in the use, provision, or contracting of these services by third parties and, therefore, shall not be held responsible for them.

1.8. The User must establish the appropriate technical security measures to avoid unwanted actions in his information system, files, and computer equipment used to access the Internet and, especially, the Website, being aware that the Internet is not completely secure.

2.- OBJECT OF THE WEBSITE

2.2. BAHIA PRINCIPE HOTELS & RESORTS is a company operating, through this Website, various hotel services offering free information about its products and tourist services. Likewise, the User may make reservations and bookings for the products and services offered on the Website.

2.3. Generally, the services and contents offered through the Website will be available in Spanish, without prejudice to the possibility – subject to BAHIA PRINCIPE HOTELS & RESORTS – of offering them in the other official autonomous languages, as well as in another language spoken in the European Union.

2.4. BAHIA PRINCIPE HOTELS & RESORTS may unilaterally and without prior notice modify the provision, configuration, content, and services of the site, as well as its terms of use and access to the provided services, without prejudice to the provisions of the particular conditions that regulate the use of a specific service and/or content.

The cost of telephone access or other connection expenses for access to the Website, if any, will be borne exclusively by the User.

3.- RIGHTS AND OBLIGATIONS OF BAHIA PRINCIPE HOTELS & RESORTS

3.2. BAHIA PRINCIPE HOTELS & RESORTS shall not be liable for damages of any nature caused by the services provided by third parties through this site, and in particular, without limitation, those caused by: (I) non-compliance with the law, morality, or public order; (II) the incorporation of viruses or any other computer code, file, or program that may damage, interrupt, or impede the normal functioning of any software, hardware, or telecommunications equipment; (III) the infringement of intellectual and industrial property rights, trade secrets, contractual commitments of any kind; (IV) the performance of acts constituting illegal, misleading, or unfair advertising and, in general, constituting unfair competition; (V) the lack of truthfulness, accuracy, quality, relevance, and/or timeliness of the contents transmitted, disseminated, stored, received, obtained, made available, or accessible; (VI) the infringement of the rights to honor, personal and family privacy, and the image of individuals or, in general, any type of rights of third parties; (VII) the inadequacy for any kind of purpose and the frustration of expectations generated, or the defects and flaws that may arise in the relationship with third parties; and (VIII) the non-compliance, delay in compliance, defective compliance, or termination for any reason of the obligations contracted by third parties and contracts entered into with third parties.

4.- INTELLECTUAL AND INDUSTRIAL PROPERTY

4.2. The trademarks, trade names, or distinctive signs appearing on the Website are the property of BAHIA PRINCIPE HOTELS & RESORTS or, where applicable, of third parties and are protected by current industrial property laws.

4.3. The provision of services and the publication of content through the Website shall not imply, in any case, the transfer, waiver, or transmission, in whole or in part, of the ownership of the corresponding intellectual and industrial property rights by BAHIA PRINCIPE HOTELS & RESORTS and/or their legitimate third parties.

4.4. Under no circumstances may the User make use of the services and content existing on the Website that is not exclusively personal, except for the exceptions determined in these general terms of use of this Website or in the particular conditions that BAHIA PRINCIPE HOTELS & RESORTS may establish to regulate the use of a specific service and/or content offered through the Website.

4.5. No part of this Website may be reproduced, distributed, transmitted, copied, publicly communicated, transformed, in whole or in part, by any system or method, manual, electronic, or mechanical (including photocopying, recording, or any information storage and retrieval system) through any medium currently known or to be invented in the future, without the consent of BAHIA PRINCIPE HOTELS & RESORTS. The use, in any manner, of all or part of the content of the Website is subject to the need to request prior authorization from BAHIA PRINCIPE HOTELS & RESORTS and/or the legitimate third parties and the acceptance of the corresponding license, if applicable, except as provided regarding the rights recognized and granted to the User in these general conditions or as determined in the particular conditions that BAHIA PRINCIPE HOTELS & RESORTS may establish to regulate the use of a specific service and/or content offered through the Website.

5.- COOKIES

BAHIA PRINCIPE HOTELS & RESORTS may use cookies when a User navigates through the sites and pages of the Website. Such cookies will be used by BAHIA PRINCIPE HOTELS & RESORTS under the conditions and for the purposes described in its Cookie Policy.

6.- DURATION

6.2. The fact that BAHIA PRINCIPE HOTELS & RESORTS does not require compliance with any of the conditions established in these general conditions or, where applicable, the particular conditions that regulate the use of a specific service and/or content intended for Users of the Website at a specific time shall not be interpreted by the User as a waiver of the subsequent requirement for their compliance.

These general conditions are governed by Spanish law.

7.- BAHIA PRINCIPE HOTELS & RESORTS expressly waives submission to transport arbitration courts for any matter arising from the existence of this contract. The consumer has the option to use the European Union online dispute resolution platform, accessible through the following link: https://ec.europa.eu/consumers/odr/main/?event=main.home2.show.

8.- JURISDICTION

The parties, with express and unequivocal waiver of their own jurisdiction, submit to the Courts and Tribunals of Palma de Mallorca (Capital) for the resolution of any disputes or controversies that may arise from the use, services, and/or products contained on this website.

CONTRACTING CONDITIONS

The website www.bahia-principe.com as well as the derived services are marketed through the company VIAJES GTI GRUPO TURÍSTICO INTERNACIONAL, S.A. (hereinafter BAHIA PRINCIPE HOTELS & RESORTS).

  1. The user declares that he/she is of legal age (i.e., at least 18 years old) and has the necessary legal capacity to contract the products and services offered on the BAHIA PRINCIPE HOTELS & RESORTS website in accordance with these general conditions, which he/she fully understands and comprehends. In the event of contracting by a minor, BAHIA PRINCIPE shall not be liable in any case, and the minor, parents, or guardians shall bear any expenses that may arise.

  2. All information provided by the user to access and use this website is true, accurate, and complete. The user is obliged to keep it updated with BAHIA PRINCIPE HOTELS & RESORTS.

  3. The user agrees that the data provided is correct, particularly regarding the credit or debit card used, which is his/her property, and authorizes BAHIA PRINCIPE HOTELS & RESORTS to charge the purchased services.

(The acquired services will be reflected in your bank statement as VIAJES GTI).

  1. Travelers are responsible for carrying all necessary documentation regarding passports, visas, etc. In some cases, a passport with a minimum validity of 6 months is required. It is recommended to consult with the authorities for the necessary requirements to travel to the specific destination. Being a baby or a child does not exempt from carrying documentation.

  2. Some countries require travelers to pay entry or exit fees or both, which must be paid per person in the country.

  3. The website www.bahia-principe.com is exclusively for the user's personal use. Modification, reproduction, duplication, copying, distribution, sale, resale, and other forms of exploitation for commercial or non-commercial purposes are prohibited.

  4. BAHIA PRINCIPE HOTELS & RESORTS reserves the right to make changes to our website and these general conditions at any time.

  5. Please ensure that you have read and understood the clauses and product information; it is your responsibility to ensure that you have done so.

  6. Price review will be permitted due to changes in transportation rates and fluctuations in the exchange rate of currencies for products or services for foreign countries offered on the BAHIA PRINCIPE website.

  7. Tickets issued, as long as provided by the respective company, will be issued in the form of an "electronic ticket".

  8. Any dispute arising from the interpretation or execution of these conditions, as well as the relationship that may arise between the user and BAHIA PRINCIPE HOTELS & RESORTS, will be interpreted under Spanish law. To resolve any discrepancies that may arise in the interpretation of these general conditions or the relationship between the user and BAHIA PRINCIPE, the parties expressly waive any jurisdiction to which they may be entitled and submit to the jurisdiction and competence of the courts of the city of Palma de Mallorca.

  9. The child rate applies to children aged 2 to 12, considering the age at the date of hotel check-in.

PRODUCTS The BAHIA PRINCIPE HOTELS & RESORTS website offers hotel reservation services. If the client wishes, they also have the possibility to request the flight service attached to the hotel service.

HOTEL Advance booking: 03 working days

Persons not included in the reservation must pay the local rate upon arrival to be included in the reservation. Please ensure that all persons have been included in the reservation.

Cancellation fees:

Flexible Rate:

No charge if the cancellation occurs 03 days or more before the check-in date at the hotel.

One night at the hotel if the cancellation occurs 02 days before the check-in date at the hotel.

Two nights at the hotel if the cancellation occurs on the same day as the check-in date at the hotel or is a "no show".

Non-Refundable Rate:

If you cancel, modify, or do not show up, 100% of the reservation amount will be charged.

The relationship established when booking the flight service is contractual directly between the airline and the end customer. BAHIA PRINCIPE HOTELS & RESORTS makes the reservation at the client's request to provide this service. The hotel service cannot be canceled while retaining the flight service. Any incident related to transport concerning this reservation (schedule changes, flight delays, luggage loss...) is the sole and exclusive responsibility of the contracting airline.

The advance reservation period via the web is 03 working days before the travel date. Reservations can be made one day in advance by calling our customer service center (900 878 072).

Cancellation: All cancellations must be processed by contacting our customer service at 900 878 072 or via email at reservations@bahia-principe.com

EXPENSES

HOTEL As described above.

FLIGHT Flights are issued as electronic tickets whenever possible.

The airfares we offer are restricted fares and are subject to specific special conditions regarding issuance, changes, cancellations, and refunds.

Flight cancellation can lead to the total loss of the fare value. If you have any questions, please consult our customer service.

Passports, visas, and documentation:

All users, without exception (including children), must have their personal and family documentation in order, whether it is a passport or ID card, according to the laws of the country or countries being visited. It will be the user's responsibility to obtain visas, passports, vaccination certificates, etc., if required by the trip. If a visa is denied by any authority for specific reasons of the user, or if entry into the country is denied for not meeting the required conditions, or due to a defect in the required documentation, or for not being the bearer of it, the organizing agency declines all responsibility for such occurrences, and the consumer will bear any resulting expenses, applying the conditions and rules established for voluntary withdrawal from services. All users, and especially those with a nationality other than Spanish, are also reminded that they must ensure before starting the trip that they meet all applicable visa requirements to enter all the countries they intend to visit. Minors under 18 years old must carry a written permission signed by their parents or guardians if they are not traveling with them, in anticipation that it may be requested by the competent authority.

OFFERS AND VACATION PACKAGES The advance reservation period via the web is 03 working days before the travel date. Reservations can be made one day in advance by calling our customer service center (900 878 072). The travel offers and other vacation packages offered through the Bahia Principe Hotels & Resorts website under the names "VACACIONES", "OFERTAS", "NOVIOS" are subject to the provisions of the consolidated text of the General Law for the Defense of Consumers and Users, approved by Royal Legislative Decree 1/2007, of November 16, and Law 7/1998 of April 13 on general contracting conditions, as well as the specific conditions of the tour operator organizing the package tour.

"The customer who has canceled their package travel contract due to COVID-19 will be issued a voucher to be used within one year from the end of the state of alarm and its extensions, for an amount equal to the refund that would have been due. After the voucher's validity period without being used, the customer can request a full refund of any payment made, as stipulated in RDL 11/2020, of March 31."

Summary of Cancellation Fees:

Between 15-10 days before departure: 5%

Between 09-03 days before departure: 15%

48 hours before: 25%

-48 hours: 100%

In the case of issued flight tickets, the cancellation fees are 100%.

EXCURSIONS Upon arrival at the destination in the hotel lobby, please reconfirm your excursion and pick-up time with the representatives of Coming2 / Soltour.

Cancellation fees:

  • No cancellation fees if the cancellation is made 3 days or more before the excursion date.
  • 50% of the amount if the cancellation occurs 2 days before the excursion date.
  • 100% of the amount if the cancellation occurs within 24 hours before the excursion date or is a "no show".

TRANSFERS

Cancellation fees:

-3 days or more: No cancellation fees if the cancellation is made 3 days or more before the transfer date. -2 days: 50% of the amount if the cancellation occurs 2 days before the transfer date. -On the same day: 100% of the amount if the cancellation occurs within 24 hours before the transfer date or is a "no show".

GOLF

Cancellation fees:

-3 days or more: No cancellation fees if the cancellation is made 3 days or more before the date. -2 days: 50% of the amount if the cancellation occurs 2 days before the date. -On the same day: 100% of the amount if the cancellation occurs within 24 hours before the date or is a "no show".

DAYPASS

Upon arrival at the hotel during check-in, you must present your ID or passport for foreigners. Payment will be made by bank card at check-in. Check-in time is 11 am, and check-out time is 6 pm. The day pass only includes the services reflected in its description.

Cancellation fees:

No charge if the cancellation occurs 03 days or more before the hotel check-in date.

If the cancellation occurs on the same day of arrival at the hotel or is a "no show," the hotel will charge a cancellation fee to the provided card.

PAYMENT METHODS The system provides different payment methods depending on the booking date concerning the departure date and the contracted product. The Flight + Hotel product has different payment conditions from the other products. Requesting a reservation implies the customer's commitment to want that reservation and committing to pay the value of it through the established payment methods detailed below. If there are unconfirmed services (RQ) when making a reservation, the system will charge if only the total payment option by card is available. If the requested services cannot be confirmed, the corresponding amount will be refunded. Accepted cards are: VISA, MASTERCARD, and MAESTRO.

Payments:

FLIGHT+HOTEL

The total flight amount will be charged to your credit card. The rest, if dates allow, can be paid before 15 days of the check-in date at the hotel by credit card or bank transfer.

OTHER PRODUCTS TOTAL PAYMENT BY CREDIT CARD

Remember that it is essential to present the card with which the payment was made and the passport at the hotel. The hotel reserves the right of admission.

Requesting a reservation implies the customer's commitment to authorize the charge on the provided payment card. The total amount of the reservation will be charged. If it is not possible to charge the total amount, 40% of the total reservation amount will be charged as a deposit. In this case, we will contact you to discuss the payment method for the remaining 60%.

TOTAL PAYMENT BY TRANSFER (THIS OPTION IS VALID IF THERE ARE MORE THAN 15 DAYS FROM THE DEPARTURE OR CHECK-IN DATE AT THE HOTEL).

We will hold the reservation with the selected and confirmed services for two working days for you to make the bank transfer to the BBVA Bank account number 0182/4899/11/0200721237, indicating the reservation number in the transfer concept. This will be printed in the reservation confirmation email you receive once the reservation is formalized. Once the transfer is made, send a copy of it by fax to 900 878 072 or by email to reservations@bahia-principe.com

ADVANCE PAYMENT OF 20% BY CREDIT CARD (THIS OPTION IS VALID IF THERE ARE MORE THAN 30 DAYS FROM THE DEPARTURE OR CHECK-IN DATE AT THE HOTEL).

20% of the reservation amount will be charged. The rest of the amount must be paid before 15 days of the departure date or check-in date at the hotel through a bank transfer to the BBVA Bank account number 0182/4899/11/0200721237, indicating the reservation locator in the transfer concept or by credit card by contacting our customer service at 900 878 072.

ADVANCE PAYMENT OF 20% BY TRANSFER (THIS OPTION IS VALID IF THERE ARE MORE THAN 30 DAYS FROM THE DEPARTURE OR CHECK-IN DATE AT THE HOTEL).

This will be printed in the reservation confirmation email you receive once the reservation is formalized. The rest of the amount must be paid before 15 days of the departure date or check-in date at the hotel through a bank transfer to the previously mentioned account, indicating the reservation number in the transfer concept or by credit card by contacting our customer service at 900 878 072.

If it is not possible to charge the card, the customer can choose to change the payment method as long as it fits one of the options described above. If it is impossible to choose another payment method due to the dates, the customer should contact us at 902 100 360 to make a reservation and look for other payment options.

TELEPHONE PAYMENT (THIS OPTION IS VALID IF THERE ARE MORE THAN 15 DAYS FROM THE DEPARTURE OR CHECK-IN DATE AT THE HOTEL)

Formalize your reservation, and once we receive your request, one of our agents will contact you to make the payment by credit card over the phone.
