GENERAL TERMS AND CONDITIONS

 

INTRODUCTION

The purpose of this document is to inform you of the general terms and conditions applicable to the services offered via the APP (hereinafter the APP) for your stay at Bahia Principe Hotels.

 

Through this APP, we provide you with information on the services offered by MANAGEMENT HOTELERO PIÑERO S.L. (hereinafter MHP), , with Tax Identification Number (C.I.F.) B57211732, registered at Av. Gabriel Roca No. 33, Edificio Mediterráneo 5 B, C and 5-1, Palma, Spain, postcode 07014.

 

Among the features offered by the APP, you will be able to:

 

- View and book entertainment activities and shows.

- Book dinners and buffets at your favourite restaurants.

- View full details of available excursions, spa treatments, golf services and premium Wi-Fi, and, where applicable, book these services.

- Make requests for butler service and room service.

 

Use of this app, as well as the services available through it, implies acceptance of the privacy policy and these terms and conditions in their latest version. We therefore recommend that you read these terms and conditions before making a booking, and each time you access our app, as we reserve the right to change, modify, add or remove any part of these general terms and conditions at any time.

 

TERMS OF USE OF THE APP

 

As a user of the APP, you undertake to use it and the services offered therein lawfully, in accordance with the provisions of these general terms and conditions, and in such a way that does not infringe the rights or interests of third parties or cause damage to or result in the abnormal use of the APP.

 

DISCLAIMER

 

Use of the APP: Use of this APP is at the user’s own risk; therefore, MHP accepts no liability for any damage arising from interference, interruptions, computer viruses, telephone faults or disconnections caused by factors beyond the control of the APP; delays or blockages in the use of this electronic system caused by deficiencies or overloads in its data centre, the Internet system or other electrical systems; nor for any other alteration that may occur in the Users’ software or hardware.

 

Similarly, MHP shall not be liable for damage caused by third parties through unlawful interference beyond our control. Nor shall it be liable for any damages caused by the use or misuse of the content of the APP, nor for any consequences that may arise from errors, defects or omissions in the content that may appear on this APP provided by third parties, third parties for these purposes being the Users of the APP in general, and the person responsible for the booking in particular.

 

BOOKING AND CONTRACT TERMS

 

The management of your booking and, where applicable, the purchase of services offered via the app is subject to the following terms and conditions:

 

1. Declarations:

You declare that:

(i) that you have full legal capacity to manage the booking and/or contract the services available on the APP

(ii) that the details provided when making service bookings are true, complete and accurate

(iii) that you confirm the booking made and/or the contracting of the service, namely the dates, times and number of people.

 

The person responsible for the bookings declares that they have the authority to manage the booking and/or the contracting of the services and, furthermore, declares that they are aware of and accept all the provisions set out in these terms and conditions.

 

2. Access to the APP:

 

Access to this APP is the responsibility of the User.

 

The User is responsible for safeguarding and treating their login credentials for the APP as confidential, preventing unauthorised third parties from accessing the APP using them.

 

Furthermore, the User declares that all information provided by them for access to the APP and during its use is true, complete and accurate, and therefore undertakes to keep it up to date during any subsequent use of the services offered on the APP.

 

3. Booking and contracting services via the APP:

 

3.1. The processing of bookings for services offered on this APP may, in some cases, be carried out either online via this APP itself or via the website of the service provider with whom you wish to contract.

 

- Online bookings and/or contracts shall be subject to these terms and conditions.

- Offline bookings will be subject to the terms and conditions provided by the service provider.

 

3.2. These terms and conditions will be displayed on the screen for your acceptance before the booking is finalised. The booking and contracting of services may be carried out in the language you selected when installing the APP.

 

3.3. To make a booking and/or contract a service via the APP, you must go to the “My Plans” screen and follow these steps:

 

1) Select the service you wish to book.

2) Select the number of people involved in the service.

3) Select the date and time.

4) Booking summary.

5) Booking confirmation.

 

3.4. At each stage of the booking process, any errors made when entering details can be corrected using the “back” function on your device. Furthermore, the booking details will be summarised in the Booking Confirmation. Should any errors be detected, users must immediately make the necessary corrections via the app or, where appropriate, notify the Hotel.

 

3.5. Once the booking has been made, you can access it at any time via the “My Plans” section of the app.

 

You may also carry out the following additional actions on your bookings, subject to certain restrictions:

· Cancel the booking.

· Change the number of people covered by the service.

 

4. Price:

 

4.1. The prices of the services that can be booked via the APP are expressly set out in the terms and conditions displayed on the screen that appears after you select the service you wish to book.

 

The following services will not incur any charge (subject to the contracted board basis and destination):

 

- Booking activities from the entertainment programme.

- Checking restaurants, booking dinners and buffets.

- Booking a workout at the hotel gym.

- Requesting available concierge services.

- Making room service requests.

 

4.2. The prices shown in the APP are Retail Prices, including indirect taxes.

 

4.3. The transaction will be carried out in the local currency of the destination, regardless of the Customer’s country of origin.

 

5. Payment method:

 

The payment method for each of the services that can be booked via the app is as follows:

 

• Spa bookings and services: these will be charged to your bill at the time of checkout.

• Excursion bookings: these will be paid for at the Tours desk.

• Golf service bookings: these will be processed and paid for offline on the GOLF platform itself.

• Show bookings: these will be settled at the time of checkout.

• Premium Wi-Fi: to be settled at checkout.

 

6. Cancellations of bookings.

 

Cancellations will not incur any administration fees provided they are made within the specified timeframe.

 

7. Acceptance

 

MHP reserves the right to amend, restrict or cancel these General Terms and Conditions at any time.

 

If any provision contained in these general terms and conditions is declared wholly or partially null and void or unenforceable, the remaining provisions shall remain in full force and effect, and such provision, or the part thereof that is affected, shall be deemed not to have been included.

 

MHP reserves the right to deny or withdraw access to the APP at any time and without prior notice to those Users who breach these General Terms and Conditions or who misuse the services and content published therein.

 

Making bookings and/or contracting services via the APP implies that you necessarily and expressly accept:

 

(i) these terms and conditions

(ii) the specific terms and conditions of the service rates

(iii) the APP’s privacy policy

(iv) the booking confirmation and request

 

In the event of any query or dispute regarding compliance, interpretation or resolution, the Parties submit to the Courts and Tribunals of Palma de Mallorca (Balearic Islands, Spain).
